1  Who we are and what this policy covers

Growth Capital Solutions of Tennessee LLC dba Southern & Pacific Lending Group (“Southern & Pacific,” “we,” “us,” or “our”) operates SandPLending.com and assists businesses and real estate investors in seeking financing. This Privacy Policy explains how we handle personal information collected through our website, inquiries, and brokerage services. Personal information includes information about identifiable individuals, including business owners, representatives, and guarantors.

Independent lenders and other third parties have their own privacy practices. This policy does not replace any separate privacy notice or consent required for a particular product, provider, or transaction.

2  Information we collect

Information you provide. Our contact form requests your name, business name, email address, and phone number. When you request financing assistance, we may also collect business and ownership details, property information, requested financing terms, financial statements, tax returns, bank statements, identification documents, and information about owners or guarantors, as relevant to your request.

Information from other sources. In connection with a financing request, we may receive information from lenders, referral partners, public records, and service providers. Credit or background information is obtained only where permitted by law and subject to any required authorization. We may retain correspondence, application status, and transaction records.

Website information. Website hosting and security services may process technical information such as IP address, browser or device information, access times, referring pages, and website activity. See the cookies section for disclosures that must be completed for this website’s actual configuration.

3  How we use information

We use information to respond to questions, assess financing needs, prepare and submit requested financing packages, communicate with prospective lenders, and coordinate applications and closings. We also use relevant information to maintain business records, administer the website, prevent fraud, investigate misuse, comply with legal obligations, and address disputes.

If we send marketing communications, we do so subject to applicable consent requirements and your communication choices. Providing information for an inquiry does not by itself authorize every form of marketing or an unrestricted disclosure of your financial information.

4  Providing information about others

Only provide information about another person when you have authority to do so. Please make this policy available to owners, guarantors, or other individuals whose information you submit. Avoid sending sensitive information through a general website contact form; ask us for the appropriate document delivery method.

5  When we share information

Prospective lenders and financing providers. When you ask us to seek financing, we may provide information relevant to your request to prospective lenders and financing providers, subject to applicable law and required authorizations. They may use the information for underwriting, verification, servicing, and other purposes disclosed in their own notices. Contact us if you have questions about recipients before your package is submitted.

Service providers and professional advisers. We may use providers for website hosting, email, document management, customer relationship management, communications, and administrative support. We share information needed for their work, subject to applicable confidentiality and data protection requirements. Professional advisers may receive information needed to advise us or handle a transaction.

Legal and protective purposes. We may disclose information when legally required or permitted to respond to lawful process, prevent fraud, protect rights or safety, enforce agreements, or resolve disputes.

Business transfers. Information may be disclosed in a proposed or completed merger, business sale, or similar transaction, subject to applicable law and appropriate confidentiality protections.

Other disclosures. We may share information as you direct or with your consent. We do not share information to unaffiliated parties for their own marketing. We do not sell information to data brokers.

6  Email phone and text communications

You may opt out of marketing emails by using the unsubscribe option, if provided, or by contacting us. Tell us if you prefer a particular method of contact. We may still send nonmarketing communications needed for an active request or transaction, consistent with applicable law.

8  Security and retention

[Confirm before publication: We maintain administrative, technical, and physical safeguards appropriate to the information we handle to reduce the risk of unauthorized access, loss, misuse, or disclosure.] No electronic transmission or storage system can be guaranteed completely secure. Contact us promptly if you believe information provided to us has been compromised.

We retain information for as long as reasonably needed for the purposes described in this policy, including processing requests, maintaining required records, complying with legal obligations, and addressing disputes. The appropriate period depends on the information, transaction, and legal requirements. [Confirm that actual retention and deletion practices follow this standard; add applicable retention periods or more specific criteria where required.]

9  Your privacy choices and requests

You may contact us to request access to, correction of, or deletion of your personal information, or to ask about our collection, use, or disclosure practices. Depending on your location, the information involved, and the law that applies, you may have additional rights such as obtaining a portable copy, opting out of certain processing, limiting specified uses, or appealing a decision. We will handle requests as required by applicable law.

We may need to verify identity and the authority of an agent making a request. Please do not email identification documents or sensitive account information until we provide an appropriate method. Some records may need to be retained for legal or transaction reasons. We will explain applicable limitations when responding. Where required by law, we will not discriminate against you for exercising privacy rights.

[Before publication, determine which state privacy laws apply and add any required state notices, request methods, appeals process, disclosures for prior periods, and functional opt-out links. This general section is not a complete state-specific notice.]

10  Children and changes to this policy

Our website and services are intended for adults seeking business-purpose financing and are not directed to children under 13. If you believe a child has provided personal information, contact us so we can investigate and take appropriate action.

We may update this policy as our practices or legal requirements change. We will post the revised policy with its effective date and provide additional notice or obtain consent when required. A policy update does not itself authorize a new use of previously collected information when consent is required.
